Criminal Defense From A Former Prosecutor

Man Falsely Imprisoned for Murder Receives $16.7M

The Los Angeles City Council has agreed to pay a man wrongfully accused of murder a settlement amount of $16.7 million.

Kash Delano Register was convinced of a 1979 armed robbery and the murder of 78-year-old Jack Sasson. He then spent 34 long years in custody prior to being released from prison in 2013.

The case against Register was based on an eyewitness testimony provided by Brenda Anderson. Although Anderson's account of what happened did not match the account provided by her sisters, this was ignored. One sister, Sheila Vanderkam, told a detective that Anderson had lied about seeing Register flee from the scene. But according to Vanderkam, the detective "put a finger to his lips" urging her to keep quiet.

The other sister had also told the police they had the wrong man in custody. She, too, was ignored.

Reopening the Case

Vanderkam looked up the Register case years later and discovered that Register was still imprisoned. This spurred Vanderkam to contact Register's attorney and a fresh examination was launched.

With the help of his lawyer and students from Loyola Law School, Register, 55, was released.

Erroneous Information Common

Erroneous information may be provided for a variety of reasons. Some of the most common include:

  • Police officers may get the facts wrong (due to error or bias)
  • Statements from witnesses may not be taken correctly
  • A minor fact may be misrepresented (i.e. the exact words used between participants in an argument)
  • Witnesses may lie
  • Victims may lie or over exaggerate
  • Photographic evidence may influence a witness

Why Pretrial Communication Is a Must

Pretrial communication is crucial if you hope to avoid a costly and risky criminal trial.

If you have been accused of murder, you should retain an experienced and reputable criminal defense lawyer as soon as you possibly can. In many instances a criminal defense attorney will be able to arbitrate the case before charges are even filed, and in many more situations a seasoned criminal defense attorney who has dealt with murder cases before will have your case dismissed.
