Criminal Defense From A Former Prosecutor

3 steps to take if police falsely accuse you of a crime

The justice system exists to punish bad people and protect good people, but it does not always work out that way. Sometimes, people face charges due to wrongful accusations of crimes. Law enforcement officials may mistakenly knock on your door and begin prosecuting you even though you are not a criminal.

If you are in this situation, you are likely feeling a lot of anger and confusion. But what you do next is crucial. Here are some general tips for what to do if you are facing wrongful accusations or criminal charges.

1. Stay quiet

If the police knock on your door and start questioning you, do not start panicking. Avoid the temptation to try and explain yourself or proclaim your innocence. Do not talk to your family members or friends about the situation. Law enforcement may use your statements against you later. The best thing you can do is remain silent until you get an attorney to advocate on your behalf.

2. Gather evidence

You may have clear proof that you are innocent. If you know anyone who can back you up on your side of the story, ask for this person to be a witness. Text messages, emails or other forms of communication may also be able to prove you are not guilty of the crime.

3. Take legal action

There are a number of legal options you have in this type of situation. Your lawyer may be able to fight against the charges and get them dropped. Another route is suing the person who started the allegations against you for defamation. You may also be able to sue the prosecutor for false imprisonment or malicious prosecution. The exact type of legal action you take will depend on the exact details of your situation.

It is frustrating to face false accusations of a crime, but try your best to stay calm and handle the situation with a level head.
