The importance of bail in criminal matters

Those who are charged with a crime in California or any other state are presumed innocent until proven guilty. However, this doesn't mean that an individual will avoid going to jail prior to the resolution of his or her case. In some cases, this is because a defendant is not allowed to post bail. In others, it is because a defendant does not have the financial resources to post bail after it is set.

Starting in 2020, New York state is set to eliminate cash bail for a majority of misdemeanors and felonies that don't involve violence. Furthermore, many who are charged with minor offenses will be given summons to appear in court instead of spending time in jail before seeing a judge. This can be ideal for those who can't afford to miss work or don't have anyone to watch their children while they are in jail.

For those who can't buy their freedom, it may be easier to plead guilty to a crime as opposed to taking the case to trial. This is because the time spent in jail waiting for a trial could exceed the maximum sentence for the crimes that they are charged. Of course, there are other consequences to having a criminal record such as having difficulty finding a job or obtaining housing.

Working with a criminal defense attorney may make it possible to reduce or eliminate the penalties associated with a charge. For instance, an attorney may be able to negotiate a plea deal that avoids jail or prison time. A legal professional may also be able to help an individual get a case dismissed by asking for evidence to be suppressed. Depending on the strength of the case against an individual, it might result in getting charges dismissed.
